The United States on Wednesday called on Vietnam to free three bloggers facing trial for propaganda against the state, voicing deep concern at the self-immolation of the mother of one of the trio.

The defendants were arrested after posting hundreds of political articles on the banned Vietnamese website "Free Journalists Club", as well as writing on their own blogs, in a case that has been raised by US President Barack Obama.

If convicted they face up to 20 years in prison, according to their lawyers.

Dang Thi Kim Lieng, the mother of one of the three, died after setting herself ablaze on Monday in front of the local authorities' offices in Bac Lieu province, according to people close to the family.

"We were deeply concerned and saddened to hear of (Lieng's) self-immolation reportedly related to circumstances surrounding the detention of her daughter Ta Phong Tan," the US Embassy in Hanoi said in a statement.

"We call upon the Government of Vietnam to release all three immediately and, as President Obama said on World Press Freedom Day, 'take the necessary steps to create a society where journalists can operate freely and without fear'," the statement said.

The government has not responded to an AFP request for comment on the self-immolation and there has been no official confirmation of the incident by the authorities, nor have Vietnam's tightly-controlled state media reported it.

Tan, a 43-year-old Catholic former policewoman, used her blog to denounce corruption and injustice in Vietnam's legal system.

She was arrested on September 5, 2011 and has been held ever since.

She is due in court in Ho Chi Minh City next week alongside Phan Thanh Hai, who blogged on highly sensitive topics including territorial disputes with China, and Nguyen Van Hai, better known by his online alias Dieu Cay.

The hearing for the trio is set to start on August 7, Dieu Cay's lawyer Ha Huy Son told AFP previously.

If shutting off an attorney’s microphone is a sign that the lawyer’s strategy is working, then Nuon Chea defence counsel Andrew Ianuzzi was on a roll yesterday, finding himself cut off at least three times during cross examination of former Khmer Rouge administrator Rochoem Tun at the Khmer Rouge tribunal.

The former Khmer Rouge number two’s defence team’s strategy is built upon the assertion that the court has been hobbled by government interference, an assertion Ianuzzi sought to prove by beginning – then being forced to abandon – lines of questioning highlighting the Khmer Rouge ties to current Minister of Finance Keat Chhon and Minister of Foreign Affairs Hor Namhong.

Ianuzzi even seemed to imply that Hun Sen himself was accountable for thousands of deaths shortly after his installation as prime minister thanks to his involvement in the bungled K5 Plan – an attempt to create a heavily mined and defended strip along the Thai border to prevent Khmer Rouge re­sistance from crossing between the two countries.

“What was the K5 mobilisation?” asked Ianuzzi, before being interrupted by court president Nil Nonn, who instructed Tun not to respond.

“Up to 50,000 individuals could have died in the implementation of the K5 Plan … Hun Sen may bear responsibility for the K5 plan and any resulting deaths,” Ianuzzi said, adding that the plan admittedly fell outside of the court’s mandate just before having his microphone turned off.

The defence counsel was cut off again shortly after asking if Tun thought that Namhong – who Tun said was “in charge” of detention centre Boeung Trabek at one point during the regime and was the former Khmer Rouge ambassador to Cuba – had failed to appear before investigating judges because the government was “afraid” of his testimony.

Ianuzzi also addressed Chhon’s time as a “senior cadre” in Democratic Kampuchea’s Ministry of Foreign Affairs, where he worked with Tun.

“He was responsible for writing speeches,” said Tun of Chhon’s duties at the ministry. “When there was a delegation, he had the duty to engage in the negotiations and keep the records.”

Ianuzzi’s microphone was cut off after asking the witness if he thought that Chhon had also refused to appear because of government pressure.

After a sustained objection from prosecutor Dale Lysak, Nonn interrupted Ianuzzi’s response, and instructed him to “use your time to put questions to the witness ... If you do not ask questions relevant to the closing order, you will not be allowed to stand on your feet, or to waste the court’s time.

A deputy police chief being sued for his alleged role in a pregnant woman being kicked in the stomach outside the appeal trial of the Boeung Kak 13 in June said yesterday he did not know what compensation the woman, who miscarried, wanted.

“Is the victim old or young, and does she sue me to return her kid?” Phnom Penh municipal deputy police chief Phoung Malay said. “I want to tell her that if she wants to get back her kid, I am also young,” he said.

Bov Srey Sras, 25, from Boeung Kak’s village 21, said she was suing Malay, Daun Penh deputy governor Sok Penhvuth and an officer who kicked her, claiming they are all responsible for inflicting “intentional violence”.

“I am suing them for my own justice and for the justice of my two-month-old unborn baby who was killed by police,” said Srey Sras, the sister of Bov Sophea, one of the 13 women on trial.

Police armed with shields and batons clashed with supporters of the Boeung Kak 13 on Sisowath Quay on June 27 as they tried to march toward the Court of Appeal to attend the women’s trial.

Srey Sras, who was caught up in the violence, was taken to the National Maternal and Child Health Centre after losing consciousness and later lost her unborn baby.

Sophea, who was released from Prey Sar prison the night of the clash after spending a month and three days in jail, said yesterday that she wanted justice for her sister.

“The justice and independence of the court will be tested in the case of my sister,” she said.

The June 27 clash is among a number of incidents in which police have been accused of violence against protesters since Borei Keila residents were evicted from their homes on January 3.

Municipal police chief Touch Naroth said yesterday he had raised with his officers the issue of not using violence when dealing with demonstrators.

“I always educate the police to be patient and flexible with demonstrators who are protesting and for them to avoid using violence,” he said. “We must turn these crackdowns into things that are peaceful.”

Some of the forces Naroth referred to were busy in Phnom Penh yesterday demonstrating nonviolent tactics they had been learning since June 13.

Naroth ordered them not to fire on protesters or commit violent acts against them in the future and said they were “waiters for the people” who should be considered friends rather than enemies.

“I would like to emphasise that the main objective of this training for our national police forces was not to crack down on people, protesters or demonstrators,” he said.

“It was to protect or prevent [people] from having strikes or demonstrations or other illegal activities in order to guarantee public order, safety and security for people in the Kingdom of Cambodia.”

Nevertheless, in cases where protesters used violence or took up weapons against police, force remained a last resort, he said.

The police also demonstrated their counter-terrorism strategies as part of yesterday’s display at the Phnom Penh police commissariat, advancing in tight formations while training their AK-47s on imaginary targets.

Pung Chhiv Kek, president of rights group Licadho, said she appreciated Touch Naruth’s orders, saying that past instances of police resorting to violence against protesters and demonstrators could not be repeated.

“I support and appreciate these orders. I hope that if the police really implement General Touch Naroth’s orders, there will be no more violent acts against protesters or demonstrators in our country,” she said.

Srey Sras said Prak Savuth, president of clerks at the Phnom Penh Municipal Court, had accepted her complaint.

“He told me he will send this complaint to his superior,” she said.

Sok Penhvuth could not be reached for comment yesterday.

Representatives from Cambodia’s two largest opposition parties meet for the first time inside Cambodia.

Officials from two key Cambodian opposition parties which have agreed to merge have met for the first time inside the country, laying the groundwork for registering their new joint party.

Some 300 members of the Sam Rainsy Party (SRP) and Human Rights Party (HRP) attended Monday’s meeting of the Cambodia Democratic Movement for National Rescue (CDMNR), the interim group implementing the merger.

The meeting at HRP’s headquarters in Phnom Penh was the alliance’s first since the two parties announced in Manila on July 17 that they were joining forces to challenge Prime Minister Hun Sen’s ruling Cambodian People’s Party (CPP) in the July 2013 general election.

Kem Sokha, CDMNR vice-president and HRP president, promised supporters the two parties are working on creating a joint political platform and will publicize it to voters before the merger.

“We are working to create a political [framework] immediately to register the new party [for the upcoming election]. We understand the laws. We won’t let our supporters down,” he said.

He added that the two parties’ commune councilors are working at the grassroots level to prepare for the merger and that representatives from the two parties say they are striving to “legally register” the party without losing their current lawmakers’ seats.

The SRP currently holds 26 seats in the National Assembly while the HRP has three, but officials say they will lose those seats if their current parties are dissolved ahead of the election.

Two to tango

CDMNR and SRP President Sam Rainsy, who lives in exile and faces charges in Cambodia that he says are politically motivated, told the meeting that the two parties will campaign both locally and internationally to press Cambodia’s government to allow for his return in time for the vote.

Addressing the meeting via Skype videoconference from an undisclosed country, he said the new joint party candidate will be a crucial alternative to Hun Sen, who has been the country’s prime minister since 1998.

“There are only two candidates for prime minister, Hun Sen and Sam Rainsy. So without my presence, there would be no election. Just as in boxing, you need two people to box,” he said.

He said they will also campaign to press the government to reform the national election commission.

The two parties had previously criticized the national election commission, saying its members are biased toward the CPP, which has ruled the country for three decades, and which easily won the country’s commune-level elections in 2002, 2007, and 2012 amid political violence and other problems.

On Tuesday, Sam Rainsy and Kem Sokha began a trip to the U.S. and other countries to drum up global support for pressure on the Cambodian government.

“Violent crackdowns have increased”

More than Cambodian 400 anti-riot police officers have completed training in the suppression of protests and dismantling of roadblocks, raising fears among rights groups and workers’ unions that the authorities may use excessive force against demonstrations.

Phnom Penh police chief Touch Naruth said however that the specially trained force from among officers from eight districts of Cambodia’s capital Phnom Penh will not be used to “crack down” on protesters.

“We should not use the words ‘crack down,’” he said, adding that the group’s training provided by Cambodia’s Ministry of the Interior and National Police Commission has been focused mainly on deterring demonstrators from violent protest.

“We should say ‘prevent,” he said.

In February, protests turned violent as a group of around 2,000 garment workers blocked a national highway and vandalized a Chinese-owned factory they said had refused to implement benefits ordered by a labor arbitration body.

Police—outnumbered and unarmed—chose not to intervene.

Equipped with riot gear and carrying automatic rifles, the newly trained 400-member anti-riot unit performed a drill on Tuesday in which they quickly suppressed a protest by about 50 “demonstrators.”

Unit 'will follow orders'

Em Saravuth, a spokesman for the police trainees, told witnesses to the drill that the new unit will strictly follow orders issued by the Interior Ministry and the police.

“We will try to prevent all crimes in the city,” he said.

Moeun Tola, labor program director at the Community Legal Education Center, said however that Cambodian police have used violent force against peaceful protesters in the past.

“Police officers should not use violent force against the people,” he said, adding that Cambodia has signed and ratified United Nations agreements defending human rights and opposing the use of torture.

Prominent unions have expressed concern over the safety of garment workers, noting that police attacked and injured at least 20 female employees of garment factories in late July.

“Phnom Penh police officers violently abused the workers,” said Cambodian Confederation of Unions president Rong Chhun.

“Violent crackdowns have increased,” he said.
